But on the contrary, this led to even more encroachment on government land. According to the government's estimate in November 2006, more than 20 lakh canals of land was illegally occupied by people. The purpose of this law, enacted in 2001, was to regularize unauthorized land. This Act envisaged the transfer of ownership rights of state land to its occupants, provided that the cost determined by the government is paid. The government said that the revenue generated from this scheme will be spent on commissioning hydropower projects, hence the name “Roshni”.

Besides, through the amendments, the government also provided free ownership rights to farmers occupying agricultural land and charged them only Rs 100 per kanal as documentation fee.

 Roshni Act was abolished on 28 November 2018 by the then Governor of Jammu and Kashmir, Satyapal Malik.

In the decade of 1990s when Hindus and Sikhs were killed and driven out of Jammu and Kashmir, more than 5 lakh Hindus, Sikhs and Buddhists of Kashmir left their houses, shops, fields and barns and fled overnight.

Those houses, shops, fields and barns were occupied but legal occupation was still pending.

So Abdullah thought, why not make the illegal legal?

In 2014, the CAG report came, which revealed that there was a scam in the matter of land transfer between 2007 and 2013. The CAG report claimed that the government deposited only Rs 76 crore instead of Rs 25,000 crore. On the orders of the Jammu and Kashmir High Court, the investigation of this case was now handed over to the CBI. Before the implementation of the Roshni Act, people had 10 lakh kanals of government land in their possession. There was a provision in the Act that only those who had possession of government land before 1990 would be able to take advantage of it. Amendments were made in 2004 and 2007 and the provision of 1990 was removed.

Meanwhile, the information about the new law was leaked. Due to which many people also occupied vacant land. The figure of occupation of government land reached from 10 lakh kanals to 20 lakh kanals. Most of the 857 people who occupied the land are politicians and bureaucrats. Earlier their names were not disclosed. Due to occupation of 20 lakh kanals of land, a scam of Rs 25,500 crore took place and the government suffered a loss.

 On 28 November 2018, this scheme was cancelled. They did this due to low revenue received under the scheme and failure to achieve the objectives. A public interest litigation was filed in the High Court regarding this. The High Court rejected this Act calling it unconstitutional. Apart from this, the court ordered the cancellation of the transfer of land distributed under it and asked to make the names of the beneficiaries public. Kashmir was in the hands of a few politicians and bureaucrats🔖
